IMPORTANT LEGAL NOTICE - READ BEFORE USING

BY ACCESSING OR USING JUSTCOOK, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS SERVICE. YOUR USE CONSTITUTES ACCEPTANCE OF ALL RISKS AND COMPLETE RELEASE OF LIABILITY. THIS IS A LEGALLY BINDING AGREEMENT.

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("User", "you", "your") and JustCook ("Company", "we", "us", "our", "Service", "Platform"). By accessing, browsing, or using JustCook in any manner, you expressly acknowledge and agree that:

You have read and fully understand these Terms in their entirety
You voluntarily agree to be legally bound by these Terms
You are at least 18 years of age or the age of legal majority in your jurisdiction
You have the legal capacity to enter into binding contracts
You assume ALL risks associated with using this Service
You waive any and all claims against the Company to the maximum extent permitted by law

2. NATURE OF SERVICE - INFORMATION ONLY

JustCook is an information aggregation and organization tool that extracts, displays, and helps organize recipe information from third-party sources. THE SERVICE IS PROVIDED STRICTLY FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY.

JustCook expressly does NOT provide:

Medical advice, diagnosis, or treatment of any kind
Nutritional counseling or dietary recommendations
Professional culinary instruction or food safety training
Allergy testing, identification, or management services
Guarantees regarding the accuracy, completeness, or safety of any recipe
Verification of ingredient safety, freshness, or quality
Food handling, storage, or preparation certifications

3. COMPLETE ASSUMPTION OF RISK

YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH USING JUSTCOOK AND ANY ACTIVITIES RELATED TO RECIPES, FOOD PREPARATION, OR COOKING UNDERTAKEN AS A RESULT OF USING THIS SERVICE.

These risks include, but are not limited to:

Allergic Reactions: Severe allergic reactions, anaphylaxis, or death from allergens, including undisclosed or cross-contaminated ingredients
Foodborne Illness: Food poisoning, bacterial infections (salmonella, E. coli, listeria), parasitic infections, or viral contamination
Physical Injury: Burns, cuts, lacerations, falls, fires, explosions, or any injuries during food preparation
Property Damage: Damage to kitchen equipment, appliances, cookware, or property
Nutritional Harm: Adverse health effects from recipes unsuitable for your dietary needs or medical conditions
Ingredient Interactions: Harmful interactions between foods and medications or medical conditions
Inaccurate Information: Errors in recipes, measurements, cooking times, or temperatures from third-party sources
AI/Technology Errors: Mistakes by artificial intelligence in identifying ingredients or providing recommendations
Third-Party Content: Any harm from content sourced from external websites we do not control or verify

BY USING JUSTCOOK, YOU ACKNOWLEDGE THAT COOKING AND FOOD PREPARATION ARE INHERENTLY DANGEROUS ACTIVITIES AND YOU VOLUNTARILY ASSUME ALL RISKS, KNOWN AND UNKNOWN.

4. COMPLETE DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
THAT DEFECTS WILL BE CORRECTED
THAT THE SERVICE IS FREE OF VIRUSES OR HARMFUL COMPONENTS
THAT ANY RECIPE OR CONTENT IS SAFE, ACCURATE, OR SUITABLE FOR ANY PURPOSE

WE MAKE NO WARRANTY THAT ANY RECIPE WILL PRODUCE THE INTENDED RESULTS, TASTE GOOD, BE SAFE TO CONSUME, OR BE APPROPRIATE FOR YOUR DIETARY NEEDS.

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JUSTCOOK, ITS OWNERS, OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR USE
PERSONAL INJURY, INCLUDING DEATH
PROPERTY DAMAGE
EMOTIONAL DISTRESS
ANY OTHER DAMAGES OF ANY KIND

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, ANY CONTENT, OR ANY RECIPE OR INFORMATION OBTAINED THROUGH THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF THE COMPANY IS FOUND LIABLE FOR ANY REASON, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, our liability will be limited to the fullest extent permitted by applicable law.

6. INDEMNIFICATION

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS JUSTCOOK AND ITS OWNERS, OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES AND LEGAL COSTS) ARISING FROM:

Your use of and access to the Service
Your violation of any term of these Terms
Your violation of any third-party right, including intellectual property or privacy rights
Any claim that your use of the Service caused damage to a third party
Any food you prepare, consume, or serve to others based on content from the Service
Any allergic reaction, illness, injury, or death related to your use of the Service
Any content you submit or transmit through the Service

THIS INDEMNIFICATION OBLIGATION WILL SURVIVE THE TERMINATION OF THESE TERMS AND YOUR USE OF THE SERVICE.

7. RELEASE OF CLAIMS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE JUSTCOOK AND ITS OWNERS, OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, RIGHTS OF ACTION, OR CAUSES OF ACTION, PRESENT OR FUTURE, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

8. BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

8.1 Agreement to Arbitrate

You and JustCook agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

8.2 Class Action Waiver

YOU AND JUSTCOOK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.

8.3 Arbitration Rules

The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitrator's decision shall be final and binding.

8.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

9. FOOD SAFETY AND HEALTH DISCLAIMERS

YOU ACKNOWLEDGE AND AGREE THAT:

Allergy Warning: Recipes may contain allergens including nuts, peanuts, dairy, eggs, wheat, gluten, soy, fish, shellfish, and sesame. Cross-contamination may occur. If you have food allergies, DO NOT rely on this Service. Always verify ingredients independently.
Medical Conditions: If you have ANY medical condition, you MUST consult with a qualified healthcare provider before following any recipe or dietary suggestion from this Service.
Cooking Safety: You are solely responsible for following proper food safety guidelines, including safe cooking temperatures, proper storage, and avoiding cross-contamination.
Third-Party Content: We do not verify, test, or guarantee the accuracy or safety of any recipe extracted from third-party websites.
AI Limitations: Our AI features may make errors. Always verify AI suggestions independently.

10. USER RESPONSIBILITIES

By using JustCook, you are solely responsible for:

Verifying all ingredients for allergens and safety before use
Ensuring all food is properly stored, handled, and cooked
Consulting appropriate professionals for medical or dietary advice
Supervising any minors involved in food preparation
Maintaining a safe cooking environment
Using appropriate protective equipment when cooking
Informing guests of potential allergens in any food you serve
Making your own independent decisions about food safety

11. USER ACCOUNTS

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your credentials, all activities under your account, and notifying us of unauthorized use. We may suspend or terminate accounts that violate these terms without notice.

12. SUBSCRIPTION AND PAYMENT

If you purchase a premium subscription, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled. Refunds are provided only as required by applicable law. We reserve the right to change pricing at any time with notice.

13. INTELLECTUAL PROPERTY

The Service, including its design, features, and code, is owned by JustCook and protected by intellectual property laws. Recipe content extracted from third-party websites remains the property of the original authors.

14. THIRD-PARTY CONTENT

The Service extracts content from third-party websites. We have no control over and assume no responsibility for third-party content. You acknowledge we are not responsible for any damage or loss caused by your use of third-party content.

15. TERMINATION

We may terminate or suspend your access immediately, without prior notice or liability, for any reason. Upon termination, your right to use the Service ceases immediately. All provisions that should survive termination shall survive, including liability limitations and indemnification.

16. GOVERNING LAW

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Subject to the arbitration agreement, any legal action shall be brought exclusively in Delaware courts.

17. SEVERABILITY

If any provision is held unenforceable or invalid, it will be modified to accomplish its objectives to the greatest extent possible, and remaining provisions continue in full force.

18. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and JustCook and supersede all prior agreements and understandings.

19. CHANGES TO TERMS

We may modify these Terms at any time. Material changes will be posted with a new "Last Updated" date. Your continued use constitutes acceptance of the new Terms.

BY USING JUSTCOOK, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND JUSTCOOK, AND THAT YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK WITH NO LIABILITY TO THE COMPANY FOR ANY OUTCOME WHATSOEVER.
